The App does not provide any professional advice, including but not limited to legal, financial, medical, or safety advice. The SOS emergency feature is a technological tool to alert emergency services and share your location — it does not guarantee a specific emergency response time or outcome. You should not rely solely on the App in life-threatening situations; always contact official emergency services directly (Pakistan Emergency: 15, 1122).
THE APP AND ALL SERVICES, FEATURES, CONTENT, AND FUNCTIONALITY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.
We do not warrant that:
4.1 Ghar Se is a technology platform only. We are NOT a transportation carrier, delivery service, common carrier, taxi service, logistics provider, or transport company. We do not employ, contract with as employees, or control any Drivers, Shopkeepers, or delivery persons in any manner whatsoever.
4.2 Drivers and Shopkeepers are independent third-party service providers who use our Platform to connect with Users. The Company exercises no control or supervision over their conduct, driving behavior, vehicle condition, route selection, product quality, pricing, or compliance with any laws or regulations.
4.3 The Company expressly disclaims all liability for any acts or omissions of Drivers, Shopkeepers, or any third parties, including but not limited to: traffic accidents, personal injury, property damage, lost or damaged goods, delayed deliveries, product quality issues, or any disputes arising between Users and third parties.
4.4 The App may contain links to third-party websites or services (e.g., Google Maps, payment gateways). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
We do not guarantee that: (a) any ride request will be accepted by a Driver; (b) any order will be fulfilled by a Shopkeeper; (c) a Driver or delivery person will arrive within any specific time frame; (d) any estimated time of arrival (ETA) is accurate. Estimated times are based on available data and may vary significantly due to traffic, weather, road conditions, driver availability, and other factors beyond our control.
TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE ISLAMIC REPUBLIC OF PAKISTAN, THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY "THE COMPANY PARTIES") SHALL HAVE ABSOLUTELY NO LIABILITY WHATSOEVER FOR ANY AND ALL INCIDENTS, LOSSES, DAMAGES, CLAIMS, OR EXPENSES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE APP OR SERVICES RENDERED THROUGH IT, INCLUDING BUT NOT LIMITED TO THE FOLLOWING:
The Company Parties shall not be liable for any traffic accidents, collisions, crashes, vehicle damage, or any other road incidents that may occur during a ride, whether caused by the Driver, another vehicle, pedestrian, animal, weather conditions, road conditions, or any other cause whatsoever. Users and Drivers use the App and participate in rides entirely at their own risk.
The Company Parties shall not be liable for any death, fatality, wrongful death, personal injury, bodily harm, physical injury, or any injury whatsoever that may occur before, during, or after a ride or delivery, whether caused by negligence, recklessness, intentional act, accident, or any other reason. This includes injuries sustained in vehicle accidents, while entering or exiting vehicles, at pickup or drop-off locations, or during any interaction with Drivers, Shopkeepers, or other Users.
The Company Parties shall not be liable for any medical emergencies, health conditions, allergic reactions, food poisoning, illnesses, diseases, heart attacks, strokes, seizures, or any medical issue that arises during or after using the App or consuming products ordered through the App. Users with medical conditions should consult their doctor before using ride or delivery services.
The Company Parties shall not be liable if a Driver, Shopkeeper, delivery person, or any third party absconds, flees, runs away, disappears, steals property, or fails to complete the service. While we perform basic verification, we do not guarantee the background, character, honesty, or reliability of any Driver or Shopkeeper. Any criminal activity by a Driver, including theft, robbery, or absconding, is the sole responsibility of the perpetrator and law enforcement authorities.
The Company Parties shall not be liable if any User, Driver, Shopkeeper, or third party is found in possession of or involved with illegal substances, drugs, narcotics, weapons, stolen property, contraband, or any prohibited items. We do not screen or inspect vehicles, packages, or persons. Any discovery of illegal items or activities is a matter for law enforcement, and the Company bears no responsibility whatsoever.
The Company Parties shall not be liable for any criminal acts, misconduct, harassment, assault, battery, kidnapping, robbery, theft, fraud, or any other illegal or inappropriate behavior by Drivers, Shopkeepers, Users, or any third parties encountered through the App. Users assume all risks associated with interacting with strangers through the platform.
The Company Parties shall not be liable for any damage to or loss of personal property, including but not limited to: mobile phones, wallets, bags, clothing, jewelry, electronics, vehicles, or any other belongings left in vehicles, at pickup/drop-off locations, or anywhere during the use of the App.
The Company Parties shall not be liable for any issues related to food or product quality, including food poisoning, allergic reactions, spoilage, incorrect orders, missing items, damaged goods, expired products, or any dissatisfaction with products ordered through the App. Shopkeepers are solely responsible for the quality and safety of their products.
The Company Parties shall not be liable for any financial losses, including but not limited to: lost wages, lost business opportunities, missed appointments, lost profits, currency fluctuations, bank charges, or any indirect financial impact resulting from delayed rides, cancelled orders, or any App-related issues.
The Company Parties shall not be liable for any emotional distress, mental anguish, psychological trauma, humiliation, defamation, loss of reputation, or any non-physical harm arising from the use of the App or interactions with any third parties through the App.
The Company Parties shall not be liable for any incidents caused by events beyond our control, including but not limited to: natural disasters, earthquakes, floods, storms, riots, civil unrest, terrorist attacks, strikes, government actions, internet outages, power failures, or any act of God.
Notwithstanding anything to the contrary contained herein, if, for any reason, a court of competent jurisdiction finds the Company liable despite the comprehensive disclaimers above, the total cumulative liability of the Company Parties for any and all claims arising from or relating to the App or its Services shall be strictly limited to the total amount of fares paid by the User to the Company in the three (3) months immediately preceding the incident, or PKR 5,000 (Pakistani Rupees Five Thousand Only), whichever is lower. This is a cap and not a floor — in most cases, liability shall be zero.
You expressly acknowledge and agree that Drivers and Shopkeepers are independent contractors and not employees, agents, joint venturers, or representatives of the Company. The Company does not provide vehicles, set working hours, control routes, determine pricing (beyond suggested fares), or supervise the work of Drivers or Shopkeepers. The Company merely provides a technology platform for connection.
By using the App, you represent and warrant that you:
You agree to indemnify, defend, and hold harmless the Company Parties from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) any dispute between you and any Driver, Shopkeeper, or other User; (d) any accident, injury, death, or property damage related to your use of the Services; (e) any illegal activity involving you.
The App is intended for use within the Islamic Republic of Pakistan. We make no representation that the App or its content is appropriate or available for use in other locations. Users who access the App from outside Pakistan do so at their own risk and are responsible for compliance with local laws.
The SOS Emergency feature is provided as a convenience tool to assist in emergency situations. It is NOT a substitute for official emergency services. We do not guarantee that emergency services will respond to SOS alerts, nor do we guarantee response times. Always contact official emergency numbers directly in life-threatening situations (Pakistan: 15 for Police, 1122 for Rescue/Ambulance, 16 for Fire). The SOS feature may be affected by network availability, device battery, GPS signal strength, and other technical factors. The Company shall not be liable if the SOS feature fails to work or if emergency services do not respond.
We use Firebase Realtime Database and Google Maps API which are third-party services. While we take reasonable measures to secure data, we cannot guarantee absolute security due to the inherent nature of the internet and technology systems. We are not liable for any data breaches, unauthorized access, or data loss caused by third-party service failures, cyber attacks, or other security incidents beyond our reasonable control. GPS tracking accuracy depends on device hardware, network connectivity, and satellite availability — we are not liable for inaccurate location data.
Any statements about future features, improvements, expansions, or capabilities of the App are forward-looking and subject to change without notice. We undertake no obligation to update any forward-looking statements.
We reserve the right to modify this disclaimer at any time without prior notice. Changes are effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the updated disclaimer.
16.1 Our Role: Ghar Se is a technology platform only. We charge a service commission (currently 10%) on each completed ride or order. This commission is our revenue.
16.2 Our Tax Obligations: Ghar Se is responsible for filing taxes (including corporate income tax and GST/Sales Tax) only on the commission amount we earn, after deducting legitimate business expenses (salaries, servers, marketing, office rent, etc.). Tax is payable on net profit, not gross revenue.
16.3 Your Tax Obligations (Drivers & Shopkeepers): As an independent service provider using our platform, you are solely responsible for declaring your own income, filing your own tax returns, and paying any applicable taxes (income tax, GST, professional tax, etc.) to the relevant authorities including FBR. Ghar Se will provide you with monthly earning statements for your records, but we do not deduct or withhold tax on your behalf unless required by law.
16.4 GST/Sales Tax on Commission: Any GST or Sales Tax applicable on Ghar Se's commission will be borne by Ghar Se and filed with the tax authorities as per applicable laws. This tax is not passed on to drivers, shopkeepers, or riders as a separate charge.
16.5 No Tax Advice: The information above is for general understanding only and does not constitute tax, legal, or professional advice. You should consult a qualified tax professional regarding your specific tax obligations.
